Factors Considered in Bail Decision
A judge will determine whether Hunter Biden, son of President Joe Biden, will be released on bail after facing federal charges related to tax evasion. The decision will depend on certain requirements being met.
Before making the bail decision, the judge must hold a hearing to gather information about the defendant. This includes details about the defendant’s residency, proximity to family, criminal record, and any threats made to witnesses involved in the case. The judge will also assess the potential danger posed by the defendant to the community, according to the Department of Justice (DOJ).
Hunter Biden’s Charges and Allegations
Hunter Biden is facing federal charges in connection with a four-year scheme where he allegedly failed to pay federal income taxes from January 2017 to October 2020 and filed false tax reports. The charges consist of three felonies and six misdemeanors, which primarily revolve around unpaid taxes that have since been settled.
Special Counsel David Weiss has accused Hunter Biden of intentionally evading at least $1.4 million in federal taxes for the years 2016 to 2019, as well as filing false tax returns in 2018. Weiss alleges that instead of paying his tax bills, Biden used his funds for an extravagant lifestyle and attempted to evade taxes by including false business deductions.
Response and Potential Consequences
In October, Hunter Biden pleaded not guilty to federal gun charges after being charged as a result of Weiss’ long-term investigation. His lawyer, Abbe Lowell, has criticized Weiss, claiming that if Biden’s last name was different, the charges would not have been brought. Lowell also accused Weiss of bowing to Republican pressure and piling on additional charges despite a previous agreement to resolve the matter.
Furthermore, Hunter Biden may face the possibility of being held in contempt of Congress for refusing to comply with a subpoena to testify about his financial dealings before House lawmakers.
