Biden: Trump Supported Insurrection, Court Decision Pending
In a significant blow to former President Donald Trump’s political future, the Colorado Supreme Court has ruled that he is barred from appearing on the state’s ballot due to his alleged role in inciting the January 6th insurrection and attempting to overturn the 2020 Presidential Election.
Strong Accusations from President Biden
When asked about Trump’s involvement in the insurrection, President Joe Biden did not mince words. He stated, “we saw it all.” Biden went on to assert that Trump “certainly supported an insurrection” and emphasized that there was no question about it. He further criticized Trump for seemingly doubling down on his actions.
Legal Battle and Dissenting Opinions
The ruling, which came in a 4-3 decision, is temporarily stayed until January 4th due to the likelihood of appeals. Three justices on the Colorado Supreme Court expressed their dissenting opinions.
The court’s majority, aware of the weight and significance of the matter, acknowledged the solemn duty to apply the law objectively and without being swayed by public opinion.
Previous Ruling and Reaction
Prior to this verdict, Colorado District Judge Sarah B. Wallace had allowed Trump to remain on the ballot. However, she concluded that he had engaged in insurrection for his role in the Capitol riot.
Colorado Secretary of State Jena Griswold, in response to the Supreme Court’s decision, stated that she would continue to adhere to court guidance on this important issue. She also noted that the ruling could be subject to appeal.
The 14th Amendment and Its Implications
The Colorado Supreme Court’s ruling is based on the interpretation of the 14th Amendment. This amendment stipulates that no person who has engaged in insurrection or rebellion against the United States or provided aid to its enemies shall hold any office.
However, the amendment also allows for removal of such disability through a two-thirds vote in both houses of Congress.
This decision could have far-reaching consequences for Trump’s political aspirations, as it adds another legal barrier to his potential candidacy in future elections.
